Paw & Property KlG
Scope
These General Terms and Conditions (hereinafter “GTC”) apply to all services offered by Paw & Property KlG (hereinafter “P&P”). By using the services of P&P you (hereinafter “customer”) accept the following terms and conditions unchanged and in full. Applicable is the current version of the GTC, which is published at the time of the conclusion of the contract. Amendments to the contract, subsidiary agreements as well as conditions of the customer shall only become part of the contract after written acknowledgement by P&P.
Data protection and copyright
The customer hereby agrees that P&P is permitted to use the personal information provided by the customer. The Privacy Policy forms the basis for the corresponding use of the personal information and is an integral part of these GTC.
All content provided by P&P is protected by copyright.
Pet Care Services
3.1 Service area and offer
P&P offers various services related to pet care in 4052 Basel (Switzerland). Other areas can be served on request. Information about the different offers is available to the customer on P&P’s website.
3.2 Conclusion of the contract
A contract is concluded after agreement between the customer and P&P on the service to be performed and the time period, the customer’s agreement to these GTC and subsequent booking confirmation by P&P.
3.3 Obligations of the customer
The obligations of the customer include in particular:
a) Registration and insurance of all pets as required by the law of the country of service provision.
b) Provision of pet food, medication, toys and hygiene products for the duration of the service. Necessary purchases by P&P will be charged with an additional service fee according to time spent (CHF 60.00 per hour)
c) Notification of veterinarian of care and payment of any medical expenses by the pet owner.
d) Timely information to P&P regarding any illnesses, allergies or other peculiarities (e.g. behavioral problems) of the customer’s animal.
e) Confirmation to P&P that the pet in question has received the usual vaccinations and is regularly dewormed and free of contagious diseases and vermin.
3.4 Liability / Damages
P&P shall take all reasonable precautions, in accordance with the relevant regulations of the country where the services are provided, to ensure the health and safety of the pet being cared for. P&P shall not be liable for any damage, contamination or loss of any pet or property, or injury, escape, illness or death of any pet occurring during the use of P&P’s services, except to the extent P&P is required to do so by law. Generally, no liability is assumed for occurrences that occur outside of service hours, especially when the pet is unattended.
The customer agrees that P&P will consult a veterinarian in case of an emergency, if time does not permit a telephone consultation with the customer. The resulting costs (incl. transport) are to be paid in full by the customer and will be charged according to time spent (CHF 60.00 per hour).
3.5 Access to the pet
During the booking period P&P requires unhindered access to the pet. Keys/access cards will be provided prior to service or placed in a lockbox for the first service visit. All keys and access cards will be kept secure and separate from client records. They will be returned in an envelope in the mailbox unless otherwise arranged. A personal handover after the service will be charged with a service fee of CHF 10.00.
3.6 Terms of payment
The customer shall pay for the booked services of P&P after conclusion of the contract and receipt of the invoice by the date specified in the invoice before the start of the service via these payment options:

- TWINT
3.7 Cancellation conditions
Refund (in % of the invoice amount)
up to 7 days before service start: 100%
up to 3 days before service start: 50%
< 3 days before service start: 0%
Early termination after service start: 0%
Prices
According to article 10 paragraph 2 letter a MWSTG P&P is not liable for VAT. All prices quoted in CHF are therefore exclusive of VAT and inclusive of other statutory charges.

Final provisions
6.1 Swiss law shall apply exclusively, to the exclusion of the conflict of laws provisions and the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Basel.
6.2 The customer may only set off claims against P&P that have been legally established and are not disputed.
6.3 P&P reserves the right to change these GTC at any time. Changes will be made available on the website and come into force when they are posted.
6.4 Should one or more provisions of these GTC be or become invalid or unenforceable in whole or in part, the validity or enforceability of the remaining provisions of these GTC shall not be affected thereby. In this case, the parties shall replace the invalid or unenforceable provision with a valid and enforceable provision that comes as close as possible to the economic purpose of the provision to be replaced. The same shall apply mutatis mutandis in the event that these GTC should contain a regulatory gap.
6.5 If the English version of the GTC differs from the German version of the GTC, the German version shall apply.
